Car accidents on Logan Road, Old Cleveland Road and the motorways
A crash on Logan Road, Creek Road, Old Cleveland Road, Kessels Road, the Pacific Motorway (M1) or any other road in the area is a CTP claim against the compulsory third party insurer of the vehicle at fault. It starts with a Notice of Accident Claim Form. The Motor Accident Insurance Commission (MAIC) says the form must be lodged within nine months of the accident (or of when symptoms first appeared), or within one month of your first meeting with a lawyer, whichever is earlier.
If anyone is hurt or in danger, call 000. Where someone was injured and police did not attend, report the crash at a police station; Policelink on 131 444 and online reporting are for crashes where nobody was hurt. Keep the police reference number (the QP number), as the CTP insurer will ask for it. A CTP claim requires the accident to have been reported to police.
If the vehicle cannot be identified, for example after a hit-and-run, or was unregistered and uninsured, the claim is made against the Nominal Defendant. Where the vehicle cannot be identified, MAIC says the claim form must be lodged within three months of the accident. Our guides on hit-and-run claims and on cyclists hit by cars cover these situations in more detail.
Injured on a bus or at a busway station
The South East Busway runs through this area, with stations at Holland Park West, Griffith University, Upper Mount Gravatt and Rochedale. A passenger injured because of the way a bus was driven, such as hard braking or moving off before they were seated, generally has a CTP claim against the bus's insurer, under the same nine-month notice rule as any other CTP claim.
A fall caused by the condition of a station, stop or platform is different: it is a public liability claim against the party responsible for the premises, under the Personal Injuries Proceedings Act 2002 (Qld). Our guide on bus, train and public transport injuries explains which claim applies.
Injured at work
Workers injured anywhere in Queensland are covered by WorkCover Queensland or their employer's self-insurer. That includes people working in retail and hospitality at Westfield Mt Gravatt and Westfield Carindale, staff at the Griffith University Mount Gravatt campus, and people who live here and commute elsewhere. The WorkCover application must generally be lodged within six months of the injury. The statutory claim pays weekly compensation, medical treatment and rehabilitation whoever was at fault; where the employer was negligent, a separate damages claim may also be available.
An injury on the ordinary journey between home and work, including on the busway, can be covered as a journey claim. If another driver caused it, there may also be a CTP claim, and our guide on journey claims explains how the two fit together.
Footpaths, parks and shopping centres
All of the suburbs on this page are in the Brisbane City Council area. If you are hurt because of the condition of a council footpath, park or other council land, in Holland Park, Tarragindi or anywhere else on this page, the claim is against Brisbane City Council. The council has an online Notice of Injury, Loss or Damage form for people who believe council wrongdoing caused an injury. A personal injury claim must still follow the Personal Injuries Proceedings Act 2002 (Qld), which starts with a formal Notice of Claim to the party responsible.
For a defect on a state-controlled road such as the Pacific Motorway, the notice goes to the Department of Transport and Main Roads. For a fall in a shopping centre or its car park, the notice goes to the occupier or owner of the centre, not the council. That applies to Westfield Mt Gravatt (formerly Westfield Garden City) in Upper Mount Gravatt, whose car parks are entered from Logan Road, Kessels Road, Link Street and Macgregor Street, and to Westfield Carindale at 1151 Creek Road, Carindale.
- Notice of Claim (part 1): within nine months of the incident (or of when symptoms first appeared), or one month after you first instruct a lawyer and the party responsible is identified, whichever is earlier.
- Court proceedings: generally within three years of the injury.
Treatment and hospital records
Princess Alexandra Hospital, at 199 Ipswich Road, Woolloongabba, and Queen Elizabeth II Jubilee Hospital (QEII), on the corner of Kessels Road and Troughton Road in Coopers Plains, are Metro South Health public hospitals. Metro South Health also runs the Mt Gravatt Nurse-led Walk-in Clinic at 1437 Logan Road, Mount Gravatt, open 8 am to 6 pm, seven days a week, for minor illnesses and injuries that are not life-threatening. It is not an emergency department.
Hospital and clinic notes are often the first record of how an injury happened and what was found. Metro South Health says its records are its property but you have the right to request the information in your medical record, with certified identity documents. A lawyer can request them on your behalf with your written authority.
Languages spoken at home
In the 2021 Census, 9.8% of Upper Mount Gravatt residents used Mandarin at home, 3.3% Cantonese and 2.9% Korean. In Mansfield, 6.9% used Mandarin, 3.0% Cantonese and 1.9% Greek. In Carindale, 68.6% used only English at home; the most common other languages were Mandarin (6.5%), Cantonese (2.9%) and Greek (2.8%).
We act in English, Mandarin, Cantonese, Hakka or Malay, so you can explain what happened, and hear the advice, in the language you are most comfortable in.
Getting to our office
Our office is in Brisbane Technology Park at Eight Mile Plains, which sits at the junction of the Gateway Motorway and the Pacific Motorway (M1). On the South East Busway, Eight Mile Plains station is the next station south of Upper Mount Gravatt, beneath the Garden City Shopping Centre bus station at Westfield Mt Gravatt. Further south, the Department of Transport and Main Roads completed the Rochedale bus station, on the corner of School and Underwood roads, in February 2025.
You do not have to travel to us. We can meet at our office, at your home, or wherever you feel is most convenient, or by phone or video.
Fees
No win, no fee. The first consultation is free. We fund the outlays needed to run the claim, and in most cases they are not payable if the claim is unsuccessful. There are situations where they become payable; these are set out in the costs agreement, which we explain before you sign.
Questions we get asked
I fell in the car park at Westfield Mt Gravatt. Do I notify the council?
No. A fall in a shopping centre or its car park is a claim against the occupier or owner of the centre, not Brisbane City Council. The Notice of Claim under the Personal Injuries Proceedings Act 2002 goes to them, within nine months of the fall, or one month after you first instruct a lawyer and they are identified as responsible, whichever is earlier.
I tripped on a footpath in Holland Park. Which council is responsible?
Holland Park and the other suburbs on this page are in the Brisbane City Council area. A claim about the condition of a council footpath is against Brisbane City Council, and starts with a Notice of Claim under the Personal Injuries Proceedings Act 2002.
I was hurt when a bus braked suddenly near Upper Mount Gravatt. What kind of claim is that?
An injury caused by the way a bus was driven is generally a CTP claim against the bus's insurer, with a Notice of Accident Claim Form due within nine months of the incident, or one month after your first meeting with a lawyer, whichever is earlier. A fall caused by the condition of a station or stop is a public liability claim instead.
Can we meet near Carindale instead of at your office?
Yes. We can meet at our office, at your home, or wherever you feel is most convenient. Our office is in Eight Mile Plains, and phone and video meetings are also available. We act in English, Mandarin, Cantonese, Hakka or Malay.
