Who we are
KW Compensation Lawyers is operated by KW Advisory Pty Ltd (ABN 81 678 634 805), a law practice in Queensland with offices at Level 2, 8 Clunies Ross Court, Eight Mile Plains and in Brisbane City (by appointment). We are bound by the Australian Privacy Principles in the Privacy Act 1988 (Cth) and by the duties of confidentiality that apply to solicitors.
What we collect
We collect personal information only where we need it to respond to you or to act for you. Depending on how you deal with us, that can include:
- Contact details: your name, phone number, email address and postal address.
- Details of your enquiry or claim: what happened, when and where, and the parties involved.
- Health information, where it is relevant to a claim: injuries, treatment, medical records and reports from doctors and other providers.
- Financial and employment information relevant to a claim: earnings, employer, superannuation and insurance details.
- Identity documents where the law or a court requires us to verify who you are.
- Website usage information, described under Analytics below.
How we collect it
Mostly from you: when you call, email, complete a form on this website, or meet us. With your consent we also collect information about you from others when acting on your claim, such as doctors, hospitals, employers, insurers, superannuation funds, WorkCover, the police, and courts. We collect sensitive information, including health information, only with your consent or where the law permits.
Why we collect it
To answer your enquiry and tell you whether we can help. To provide legal services, including assessing, preparing, negotiating and litigating your claim. To communicate with the people and organisations involved in your claim. To manage our relationship with you, including costs agreements and accounts. To meet our legal and professional obligations, including record-keeping, trust accounting and anti-money-laundering requirements. We do not sell personal information, and we do not use it for marketing to you without your consent.
Who we share it with
Only as needed to act for you or as the law requires, for example: barristers, medical and other experts, insurers, superannuation funds, WorkCover, other parties and their lawyers, courts and tribunals, disbursement funders, and service providers who support our practice (such as practice management software, document storage, email and telephony providers) under obligations of confidentiality. We do not disclose information about a client's matter to anyone else without the client's authority, except where required by law.
Overseas
Some of our service providers store data on servers outside Australia. Where that happens we take reasonable steps to ensure the provider handles the information in a way consistent with the Australian Privacy Principles.
Analytics and this website
This website uses Google Analytics to understand how it is used: which pages are visited, for how long, and from what kind of device and general location. Google Analytics sets cookies in your browser for this purpose. The data is aggregated and does not tell us who you are. You can turn it off with the switch below, and the site will work exactly the same. We do not use advertising cookies or sell browsing data. Forms on this site are delivered to us through a form service and are not stored on the website itself.
Analytics is on in this browser.
How we keep it safe
Client files are held in secure practice management and document systems with access limited to the people working on your matter. We use multi-factor authentication, encrypted storage and encrypted email where available. We keep client files for at least seven years after a matter ends, as our professional rules require, and then destroy or de-identify them securely.
Access and correction
You can ask to see the personal information we hold about you, and ask us to correct it, by contacting us using the details below. We will respond within a reasonable time and usually without charge. In some situations the law allows us to refuse or limit access, and we will tell you why.
Complaints
If you have a concern about how we have handled your personal information, please tell us first at info@kwcl.com.au and we will look into it and respond within 30 days. If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner at oaic.gov.au.
