Who we act for in the Redlands
We act for people who live or work in the Redlands and have been injured in a car, motorcycle, bicycle or pedestrian accident, at work, or in a public place such as a footpath, park or shopping centre. We also act on total and permanent disability (TPD) and income protection claims through superannuation.
Our office is at Level 2, 8 Clunies Ross Court, Eight Mile Plains, and we also have a Brisbane City office for meetings by appointment. We can meet at our office, at your home, or wherever you feel is most convenient. Phone and video meetings are also available, which some clients in Redland Bay and Victoria Point prefer. We act in English, Mandarin, Cantonese, Hakka or Malay.
Car accidents on Redlands roads
If you are injured in a crash on Old Cleveland Road, Mount Cotton Road, Cleveland–Redland Bay Road or any other road in the Redlands, the claim is a CTP claim against the compulsory third party insurer of the vehicle that was at fault. It starts with a Notice of Accident Claim Form. The Motor Accident Insurance Commission says the form must be given within nine months of the accident (or of when symptoms first appeared), or within one month of first consulting a lawyer, whichever is earlier.
The crash should also be reported to police. The Queensland Police Service takes reports of crashes where nobody was hurt online or through Policelink on 131 444. Where someone was injured, police say to call Triple Zero (000) if you are still at the scene, or otherwise to report the crash at a police station.
If the vehicle that hit you cannot be identified, or was unregistered and uninsured, the claim is made against the Nominal Defendant. When the vehicle cannot be identified, MAIC says the Notice of Accident Claim Form must be lodged within three months of the accident, so these claims need attention early.
Injured at work
Whether you work in the Redlands or travel elsewhere for work, an injury at work in Queensland is covered by WorkCover Queensland or your employer's self-insurer. The application must generally be lodged within six months of the injury. The statutory claim pays weekly benefits, medical treatment and rehabilitation whoever was at fault; where the employer was negligent, a separate damages claim may also be available.
An injury on the ordinary journey between home and work can be covered as a journey claim. If another driver caused the crash, there may also be a CTP claim, and the two run side by side.
Falls on footpaths, in parks and in shopping centres
All of the suburbs on this page are in the Redland City Council area. If you are injured because of the condition of a council footpath, park or other council land, a Notice of Claim under the Personal Injuries Proceedings Act 2002 (Qld) goes to Redland City Council. If the injury happened on a state-controlled road, the notice goes to the Department of Transport and Main Roads, which is responsible for roads such as Cleveland–Redland Bay Road. For a fall in a shopping centre in Capalaba, Cleveland or Victoria Point, the notice goes to the occupier or owner of the centre.
Redland City Council's claims page says it assesses claims under the Civil Liability Act 2003 (Qld), that claims can be lodged online, by email, by post to PO Box 21, Cleveland, or at a Customer Service Centre, and that claims involving a council contractor are referred to that contractor.
- Notice of Claim: within nine months of the incident (or of when symptoms first appeared), or one month after you first instruct a lawyer, whichever is earlier.
- Court proceedings: generally within three years of the injury.
Treatment and hospital records
Redland Hospital on Weippin Street, Cleveland, is the public hospital in the area, with an emergency department open 24 hours a day, 365 days a year. It is part of Metro South Health. Hospital records are often the first evidence of an injury: the notes of how it happened, what was found and what treatment was given.
You can ask the hospital for a copy of your records. Each Hospital and Health Service handles requests for the records it holds, so if you were treated at more than one public hospital, a request goes to each. With your written authority, we can request them for you.
Languages spoken at home in the Redlands
At the 2021 Census, 88.9% of people in the Redland local government area used only English at home. The most common other languages were Afrikaans (0.6%) and Mandarin (0.6%), followed by Punjabi, Spanish and German. In Capalaba, 86.0% used only English at home, and Mandarin was the most common other language (0.8%).
We act in English, Mandarin, Cantonese, Hakka or Malay, so you can explain what happened, and hear the advice, in the language you are most comfortable in.
Getting to us
Our office is at Level 2, 8 Clunies Ross Court, Eight Mile Plains, in Brisbane Technology Park, near the Pacific Motorway (M1) and the Eight Mile Plains busway station on Miles Platting Road. The Cleveland train line runs through Ormiston, Wellington Point, Birkdale and Cleveland toward the city.
You do not have to travel to us. We can meet at our office, at your home, or wherever you feel is most convenient, or by phone or video.
Fees
No win, no fee. The first consultation is free. We fund the outlays needed to run the claim, and in most cases they are not payable if the claim is unsuccessful. There are situations where they become payable; these are set out in the costs agreement, which we explain before you sign.
Questions we get asked
I tripped on a footpath in Cleveland. Who is the claim against?
If the footpath is council land, the claim is against Redland City Council and starts with a Notice of Claim under the Personal Injuries Proceedings Act 2002. The council says that where a contractor was responsible, it refers the claim to that contractor. The notice is due within nine months of the fall, or one month after you first instruct a lawyer, whichever is earlier.
Who is responsible for Cleveland–Redland Bay Road?
It is a state-controlled road, so the Department of Transport and Main Roads is responsible for it. A claim about the condition of the road goes to the department, while a crash caused by another driver on that road is a CTP claim against that driver's insurer.
I was treated at Redland Hospital after a crash. How do I get my records?
Redland Hospital is part of Metro South Health, which handles requests for the records it holds. You can request them yourself, or we can request them for you with your written authority.
Do I have to come to Eight Mile Plains to see you?
No. We can meet at our office, at your home, or wherever you feel is most convenient, and phone and video meetings are also available.
