Car accidents on the Ipswich and Centenary Motorways and local roads

Whether the crash happened on the Ipswich Motorway, the Centenary Motorway, the Cunningham or Warrego Highway, the Springfield Greenbank Arterial or a suburban street in Booval or Brassall, the claim is a CTP claim against the compulsory third party insurer of the vehicle that was at fault. It starts with a Notice of Accident Claim Form. The Motor Accident Insurance Commission says the form must be given within nine months of the accident (or of when symptoms first appeared), or within one month of first consulting a lawyer, whichever is earlier.

The crash should also be reported to police. The Queensland Police Service takes reports of crashes where nobody was hurt online or through Policelink on 131 444. Where someone was injured, police say to call Triple Zero (000) if you are still at the scene, or otherwise to report the crash at a police station.

If the vehicle that hit you cannot be identified, or was unregistered and uninsured, the claim is made against the Nominal Defendant. When the vehicle cannot be identified, MAIC says the Notice of Accident Claim Form must be lodged within three months of the accident.

Injured at work, or on the way to work

An injury at work in Queensland is covered by WorkCover Queensland or your employer's self-insurer, whether you work in Ipswich, in Springfield Central, or travel into Brisbane. The application must generally be lodged within six months of the injury. The statutory claim pays weekly benefits, medical treatment and rehabilitation whoever was at fault; where the employer was negligent, a separate damages claim may also be available.

An injury on the ordinary journey between home and work can be covered as a journey claim, and if another driver caused the crash there may also be a CTP claim. The two can run side by side, each with its own time limits.

Falls on footpaths, in parks and in shopping centres

All of the suburbs on this page are in the Ipswich City Council area, including Springfield, Springfield Lakes and Springfield Central. If you are injured because of the condition of a council footpath, park or other council land, a Notice of Claim under the Personal Injuries Proceedings Act 2002 (Qld) goes to Ipswich City Council.

If the injury happened on a state-controlled road, such as the Centenary Motorway, the notice goes to the Department of Transport and Main Roads. For a fall in a shopping centre in Springfield Central, Redbank Plains or central Ipswich, the notice goes to the occupier or owner of the centre. Working out who controls the place where you fell is the first step, and it is not always obvious from the site itself.

  • Notice of Claim: within nine months of the incident (or of when symptoms first appeared), or one month after you first instruct a lawyer, whichever is earlier.
  • Court proceedings: generally within three years of the injury.

Treatment and hospital records

Ipswich Hospital on Chelmsford Avenue, Ipswich, is the public hospital in the area, with an emergency department open 24 hours a day, 365 days a year. It is part of West Moreton Health. Hospital records are often the first evidence of an injury: the notes of how it happened, what was found and what treatment was given.

You can ask the hospital for a copy of your records. Each Hospital and Health Service handles requests for the records it holds, so if you were treated at a public hospital in another health service area as well, a separate request goes there. With your written authority, we can request them for you.

Languages spoken at home in Ipswich and Springfield

At the 2021 Census, 79.8% of people in the Ipswich local government area used only English at home. The most common other languages were Samoan (1.9%), Punjabi (1.0%) and Vietnamese (0.9%), followed by Malayalam and Hindi. In Springfield Lakes, 70.4% used only English at home; the most common other languages were Punjabi (2.8%) and Vietnamese (2.2%), and a non-English language was used in 29.8% of households.

We act in English, Mandarin, Cantonese, Hakka or Malay, so you can explain what happened, and hear the advice, in the language you are most comfortable in.

Questions we get asked

I fell on a footpath in Springfield Central. Is that Brisbane City Council or Ipswich?

Springfield Central, Springfield and Springfield Lakes are all in the Ipswich City Council area. If the footpath is council land, the Notice of Claim under the Personal Injuries Proceedings Act 2002 goes to Ipswich City Council, within nine months of the fall or one month after you first instruct a lawyer, whichever is earlier.

I was hurt in a crash on the Ipswich Motorway driving to work. Is that WorkCover or CTP?

It can be both. The ordinary journey between home and work can be covered by WorkCover as a journey claim, and if another driver was at fault there may also be a CTP claim against that driver's insurer. Each has its own forms and time limits.

The driver who hit me drove off. Can I still claim?

Yes, the claim is made against the Nominal Defendant. MAIC says the Notice of Accident Claim Form must be lodged within three months of the accident when the vehicle cannot be identified, so report the crash to police and act early.

Do I have to come to Eight Mile Plains to see you?

No. We can meet at our office, at your home, or wherever you feel is most convenient, and phone and video meetings are also available.
