We also act in TPD and income protection claims through superannuation. Our offices are at Eight Mile Plains (Level 2, 8 Clunies Ross Court) and in Brisbane City (by appointment). Car accidents in the area

If another vehicle caused your injuries, the claim is made against that vehicle's CTP insurer, not against the driver personally. It starts with a Notice of Accident Claim Form, which must be given within nine months of the accident (or of symptoms first appearing), or within one month of first meeting a lawyer about the claim, whichever is earlier. If the vehicle cannot be identified or was uninsured, the claim is against the Nominal Defendant and the form is due within three months of the accident.

A crash must be reported to police where someone needs medical attention, where a driver will not give their details, or where a vehicle has to be towed. If anyone is hurt or in danger, call 000. Where someone was injured and police did not attend, report the crash at a police station; Policelink on 131 444 and online reporting are for crashes where nobody was hurt. Keep the police reference number (the QP number), as the CTP insurer will ask for it.

The area is crossed by busy roads, including the Ipswich Motorway between Rocklea and Darra, Beaudesert Road through Acacia Ridge and Moorooka, and Kessels Road at Coopers Plains. Whether a crash happened on a motorway or a suburban street makes no difference to the CTP process.

Injured at work

Acacia Ridge and Archerfield have large industrial areas, and Acacia Ridge is home to a road and rail freight intermodal terminal. Injuries in freight, warehouse and factory work commonly include back and shoulder injuries from lifting, forklift and loading dock accidents, falls from trucks and machinery injuries.

Any worker injured in the course of their work in Queensland can apply for WorkCover benefits, whoever was at fault. The application should be lodged within six months of the injury, or of first seeing a doctor about it. Casual, labour hire and many contract workers are covered as well as permanent employees. If the employer, or someone the employer is responsible for, was negligent, there may also be a separate damages claim. Injuries on the way to or from work can be covered too.

Falls in public places and on council land

All of the suburbs on this page are in the Brisbane City Council area. If you were hurt because of a defect on a council footpath, road, park or other council land, the claim is against the council. Brisbane City Council has an online Notice of Injury, Loss or Damage form, and its claims are managed by an authorised third-party claims manager. Reporting the incident through that form is not the same as the formal Notice of Claim the law requires.

Under the Personal Injuries Proceedings Act 2002, a Notice of Claim must be given to the party responsible: the council for its footpaths and local roads, the Department of Transport and Main Roads for state-controlled roads, and the owner or occupier for a shopping centre, supermarket or other private premises. It must be given within nine months of the incident (or of symptoms first appearing), or within one month after you first instruct a lawyer to claim against an identified party, whichever is earlier. Court proceedings must generally be started within three years.

Treatment and your medical records

Public hospitals in and near the area include the Queen Elizabeth II Jubilee Hospital (QEII) on the corner of Kessels Road and Troughton Road, Coopers Plains, and the Princess Alexandra Hospital at 199 Ipswich Road, Woolloongabba. Both have emergency departments open 24 hours a day and are run by Metro South Health.

Hospital records are often the first written account of how an injury happened. You can apply to the hospital for a copy of your own records, and with your signed authority we can request them for you, along with records from your GP, physiotherapist and other treating practitioners.

Getting to our office

Our office at Level 2, 8 Clunies Ross Court is in Eight Mile Plains, a suburb served by the Eight Mile Plains busway station on the South East Busway and the Pacific Motorway (M1). Fees

No win, no fee. Our professional fees are only payable if the claim succeeds. We fund the outlays needed to run the claim, and in most cases they are not payable if the claim is unsuccessful. There are situations where they become payable; they are set out in the costs agreement, which we explain in writing before you sign anything. The first consultation is free.

Questions we get asked

I tripped on a footpath in Inala. Who do I claim against?

For a council footpath or local road, the claim is usually against Brisbane City Council. If the fall happened on or beside a state-controlled road, the Department of Transport and Main Roads may be responsible, and in a shopping centre it is the owner or occupier. The Notice of Claim must reach the right party within the time limit, so it is worth checking early.

I was hurt at a warehouse in Acacia Ridge through a labour hire agency. Who do I claim against?

The WorkCover application is made through the labour hire agency, which is usually your employer. If the host business where you were working was negligent, there may also be a damages claim against it. The two claims run side by side, and we can tell you which apply at the first meeting.

My parents speak Vietnamese and limited English. Can you help?

We act in English, Mandarin, Cantonese, Hakka or Malay, and we do not offer Vietnamese ourselves. A family member or friend your parents trust is welcome to come to the meetings and help them follow what is discussed.

Do I need to come to your office?

No. We can meet at our office, at your home, or wherever you feel is most convenient, or by phone or video. The first consultation is free.
